Truth Seeker: Black Rock and The Chateau are in violation of the Comprehensive Plan of Kootenai County. The Comprehensive Plan must be changed for these developments to be legally approved. This issue has already gone to court and has been decided....the zoning must follow the comprehensive plan. The County and the Commissioners are in violation of the law if thay pass them. They have been violating the law for a number of years. If anyone is interested I can go into more detail and state case law. Mr. Stone is not entitled to put in Black Rock II. He was never entitled to put in Black Rock I. I see legal action coming from the citizens if these developments are approved as they violate the law.

DFO: Bingo. The Kootenai County commissioners are under no obligation to grant a change to the comprehensive plan. If I were any of them, I'd punt these down the road and wait for a rewrite of the comprehensive plan. Of course, the two lame ducks would be off the board then, and we'd get to see whether Todd Tondee and Rich Piazza are up to the task of controlling growth.
