Court: Sanders Beach Homeowners Lose Round

More Info: "The one federal claim is dead unless the plaintiffs appeal judge Lodge's decision," said City Attorney Mike Gridley. As a result of the decision, the plaintiffs will not be able to collect attorney's fees from the city and county on the federal claim.

DFO: I recall that the Sanders Beach owners, their sympathizers and the Coeur d'Alene Press were making solemn decrees re: how liable the city was for taking the issue of ownership to court. As though it was a cut-and-dry deal that the East Lakeshore Drive owners also owned the beach. A lower court wasn't as sure. This ruling means the city acted responsibly. 'Tis nice to know that the homeowners and Magnuson won't get attorney's fees. Now, mebbe these birds'll content themselves in enjoying the patch of sand in front of their houses while the huddled families of the neighborhood are forced to share small patches of sand nearby.
