The Attorney General’s Office has concluded an investigation of allegations of conflicts of interest regarding Lake City Development Corporation (LCDC) chairman Charles Nipp. Attorney General Lawrence Wasden’s office notified Kootenai County Prosecuting Attorney Barry McHugh that the Attorney General will not be filing criminal charges/Bob Cooper, spokesman for Idaho Attorney General’s Office. In other words, since the CAVE’rs are not “Stake Holders” they’re anti everything.

Truth is, and I know this will rub you the wrong way, the elected officals making the decisions were put there by the “Majority” to make the decisions you find so galling.
Descention and speaking your mind on an issue you may not agree with is your right. That’s fine, I will support your right to do so. But, nagging (Mary’s Press Column), false accusations (Dirt Gate), secret recordings, (No Description Necessary) and down right lies(Accusing Board of causing a Heart attack) to further ones personal agenda is a totally different matter.

Dennis, yes they were elected by the people, but what’s so sad is the ‘minority’ made the decisions for the ‘majority’, b/c only 22% of registered voters actually vote in local elections in KC.Why? I think it’s because, people are fed up with politics and they don’t believe change will happen.

While, Mr.Nipp technically violated the law, there was no criminal intent on his part.Nevermind the fact that 6 of the properties were financed for LCDC by Mountain West Bank and Charlie was the chairman of LCDC and on Mountain West Banks board.

Kage; this isn’t OpenCDA.com or the Press blogs where you can make accusations against fine citizens like Charlie Nipp at will. On his worst day, Nipp is a better citizen than the band of his accusers who have coagulated on the aforementioned Web sites. The city of Coeur d’Alene is fortunate to have individuals of his calibre willing to spend the hours and take the heat from a small gang of naysayers — insert word CAVEr here if you’re so inclined — who exist only b/c they have the ear of CDA Press management. The AG’s report says no conflict. To continue to assert that Charlie has a conflict, despite the official opinion and his stellar character, sets you apart as someone who doesn’t allow facts to stand in the way of a conspiracy theory.

I wonder how many people picked up for DUI don’t realize that they are driving legally impaired? Given the statute of limitations ran long before the investigation even got to the AG the intro to this post is misleading. No charges would, or could, have been filed anyway. The opinion’s purpose seems to merely address the fact that LCDC members are subject to conflict of interest requirements. Hopefully this will be good for all, and help everyone govern their actions accordingly. Too bad that Mr. Nipp got to be the test case on the issue.

DFO, I know Mr.Nipp is a good citizen.But, it is clear that there are conflicts of interest with LCDC board members owning land in LCDC districts.I would like to see the state legislature get involved and pass laws concerning this issue.BTW, I don’t agree with everything mary says either.

Kage, as you may know, I was involved in forming LCDC in 1997. From the start Charlie Nipp as Chairman was a tremendous asset to us, often giving direction that actually could have been perceived as hurting his business interests, rather than helping them. Case in point, the boundary of the District including NW Boulevard and the mill property that has become Riverstone, has arguably created competition to his interests.
The only gain Charlie has seen is the same benefit we’ve all experienced in Coeur d’Alene, a strong and vibrant downtown business district now extending both north and east to I-90.
If you feel strongly about changing urban renewal law I urge you to do so, without allegations that anyone is ‘in bed’ with anyone else That kind of dialogue only disparages the character of good people like Charlie Nipp.

Kage; one thing I’ll concede to you. And I have conceded this before. Way back when, before Mary, DanG & others headed out from here … the pressure put on the LCDC by the anti-LCDC crew forced the urban renewal types to tighten up the way they do things. I continue to believe that the anti-LCDCers took things way too far in their attacks against urban renewal. But I’ve gone round and round on this subject in years past with some on your side — and discovered it was a fruitless pursuit.

AG’s Report:
“Our investigation revealed that Mr. Nipp’s conduct, while constituting a technical violation of the statutes, does not rise to the level of a prosecutable crime,” Deputy Attorney General Stephen Bywater wrote in a letter to Mr. McHugh.
Further in the report:
“It appeared clear to us that his failure to disclose his potential conflict of interest was not done with the intent to defraud or deceive LCDC, but rather was the result of his belief that he did not have a conflict. Although this belief was in error, we do not believe that Mr. Nipp acted with criminal intent,” Bywater wrote.“As such, we believe that criminal charges would not have been appropriate given the facts of this case and that filing such charges would not have served the interests of justice irrespective of the statute of limitations issues.”
“technical violation” and “his belief that he did not have a conflict, Although this belief was in error”. It appears that the AG did find a conflict of interest but not to the level of a prosecutable crime.

Aw, c’mon wheels. I don’t care if Charlie Nipp teaches Sunday School at every church in town. When he had his Mountain West hat on, he should have disclaimed on the LCDC work on the table. Conflicts of interest is meat of what the ethics crisis in American politics is these days. Well, that and paying taxes on household employees, I guess.
