Nipp Wants AG, Senator Records

The investigation involving former Lake City Development Corp. Chairman Charlie Nipp isn’t over . Nipp, through his attorney, has requested copies of all correspondence between Sen. Mike Jorgenson, his constituents and the Idaho attorney general’s office prior to the criminal investigation on the former chairman. The request was made on Thursday by Nipp’s lawyer, Scott Reed, in a letter to Jorgenson citing Idaho’s Freedom of Information Act/Tom Hasslinger, Coeur d’Alene Press. More here.

Question: Where do you think this is headed?

I think Charlie deserves to know all of the facts. Approximatley two years ago I heard the Rep. Henderson requested the AG look at my service on two school boards(Dist. 271 & NIC) and determine if it was legal. According to my source the AG found nothing that prevented me from serving my community in both capacities.
I have not looked into it. I just let it go. So if my source was wrong I apologize upfront to Rep. Henderson for bringing this up. But I did find it curious that Rep.Henderson felt strongly enough about my elected positions to have it investigated yet never mentioned it to me. We run into each other a lot at various functions so it would have welcomed the conversation rather than feeling like I was blindsided by my represetative.

    This still isn’t news.

  • JBelle on March 14 at 12:13 p.m.

    hahahahaha!

As we would have said at 10th and Penn if’n we’d known about Hindi at the time, “karma is a female dog…”

  • PatrickH on March 14 at 1:46 p.m.

There is no way that this doesn’t end up in court. Odds are is that the AG will not release the names, Jorgenson has made it more then clear that he won’t release the names, and Mr. Nipp is not about to back down either, I don’t see anyway this does not end up in court. Nipp needs to let it go and move on. Ya, we get it your pissed at whoever ask for the investigation, but really is embarking on a course that will just end up costing the taxpayers more money and keeping a dead issue in the news really what is best for the board you sit on?

  • Joker on March 14 at 1:51 p.m.

Who gives a flying f about this stupid story. BORING

  • JBelle on March 14 at 2:16 p.m.

So Patrick, if I understand your argument correctly, it’s quite fine for a certain group of taxpayers to pursue a certain course of action at taxpayer expense but when one of the principles in said course of action continues pursuit, still at taxpayer expense, that’s not fine nor a prudent course of action? Far as I can tell, all parties to this matter are citizens of city of Coeur d’Alene, county of Kootenai and state of Idaho, all with equal rights under the law. Charlie Nipp has only had his day in court indirectly at the hand of what some might call malicious persecution; he now seeks his day in court in a direct manner, as guaranted to him by law. Just as when you volunteer your time and talent you do not become immune from the law, you neither give up your rights under the law either. I say, call ‘em Charlie. Let’s see what they got.

  • JBelle on March 14 at 2:20 p.m.

Joker, I think this story is fascinating and far from over. It’s not about politics in Kootenai County, not about the LCDC, not about the use of public funds. Rather it’s about the role of a volunteer in municipal/enterprise collaborations. Charlie Nipp well may cast further definition, perhaps make new law, over such in Idaho as this incident continues to unfold.

  • nic on March 14 at 3:09 p.m.

I think there are a lot of e-mails being deleted and papers being shredded at the offices of Sen. Mike Jorgenson. Of course that is pure speculation, and may not have any validity.

  • PatrickH on March 14 at 3:10 p.m.

    Actually JBelle,

I don’t like the tactics of the anti-lcdc crowd. I think that they are sleazy, possibly even unethical, but at some point someone should be the bigger person. Dragging this out is of no use to anyone. Keeping this same tired story in the news just adds fuel to Mary and Dan’s napalm bonfire. Mr. Nipp should move on and continue with the work of helping LCDC bring development to Coeur d’Alene that can help this community thrive and grow.

  • JBelle on March 14 at 3:24 p.m.

my point, Patrick, is that an ancillary issue has now been pushed to the forefront, the LCDC COI issue having been settled. Charlie Nipp shows his usual courage by asserting that all the players in an certain investgation can be named. This disclosure is/would be invaluable to anyone, now, then or in the future who has sat on a community board. Particularly in Kootenai County!

This isn’t LCDC business; it’s an issue of volunteerism that should be explored. Particularly** in Kootenai County.

  • Joker on March 14 at 11:27 p.m.

    Jbelle,

I guess if you like insider baseball called CDA politics it’s interesting. But trust me, it’s not. Some people like to watch the history channel and some like to watch the Cartoon Network. It’s simply entertainment, nothing more. It’s not important, it’s not relevant.

  • JBelle on March 15 at 9:03 a.m.

Joker, Don’t forget. I do not live in CdA and have not for many years. The people just aren’t that interesting to me because I don’t know them. Except for Kennedy. And I think he’ll be a US senator before his children are through at LCHS. Or whereever he has them. So the latest turn of the worm in the mighty LCDC Brouhaha is indeed interesting to me because not only is it about the rights of a volunteer in the community but it’s about something quintessentially, fundamentally American: the right to face one’s accuser. Charlie Nipp was not accorded that formality and he is pursuring his rights under the law. I don’t watch much TV at all but I am going to assume the History Channel is the place you’d find reenactments of the American lore surrounding constitutional law. I personally prefer to read the books regarding such and find the Broadway stage to my style of entertainment. Although if there really is a Cartoon Network and you are not being facetious, I would love to know: do they do the old time ones, with the classical music? Bugs Bunny? Micky Mouse? Popeye? I’d love to watch those.

  • Joker on March 15 at 9:25 a.m.

    Jbelle,

Rights of the volunteer? What rights are those? Are those a seperate set of rights? I think you need to explain this point in detail.

Consider what impact Nipp’s request to the AG will have on whistleblowers. People will be even more discourage to come forward with what they believe to be a wrong if they could lose their job or face public humilation.

Mr. Nipp committed no crime, no charges were filed against him. More over, this is a small town. He can make an educated guess as to who went to Jorgenson. It’s no secret who the cave gang is.

Before you accuse me of being on their side, let me assure you thatI am not a CAVER. I think that group is a bunch of wingnuts. But come on, Nipp should just let this one go. He wasn’t perfect, but who is.

It’s a shame Mr. Nipp is “choosing” to get down in the mud with these people. It’s petty and vindictive.

  • yabetcha on March 15 at 11:16 a.m.

Joker, shame on you! You can talk like a caver but put them down as a straw man so you’re relevant.

  • Joker on March 15 at 11:27 a.m.

    Yabetcha,

I don’t follow you. I don’t support the CAVE doctrine. I am just saying Nipp is making a mistake. Nobody cares about this tempest in a teapot.

    Jbelle,

Mike Kennedy probably won’t ever be a U.S. Senator. Not in Idaho anyway. The Dems in North Idaho are completely lost at sea.

  • JBelle on March 15 at 11:52 a.m.

Joker, I wrote you a long and impassioned response but either my hardware or dfo’s software ate it. So much for civil dialogue and Sunday brunch.

Refer back to my earlier post for my take on a volunteer’s plight as they discharge their duties. Just as they are not immune from their responsibilities under the law so do they not forfeit their rights under the law.

One of the things that makes us American citizens and different than the subjects of the Queen of England, the late Tsars and the Kings of Africa is our rights. Chief among is the right to face our accuser. Charlie Nipp has that right and now that he has had due process in determing his responsibilites under the law with regard to his position with the LCDC, he asks the next question and I believe a question tantamount to the American experience: who exactly was my accuser? And not incidental to this, anybody who sits on a community or not for profit board of any kind should be quite interested in this question and the answer the courts and/or the system provides. So quite far from being small minded, Charlie Nipp steps up again and asks the big questions.

And frankly, who ever instigated this inquiry should sack up and be counted. Important enough to get AG involved but not important enough to call foul to Charlie’s face? Gawd, even Hoopfest has a better system of justice than that!

  • JBelle on March 15 at 11:58 a.m.

Joker, did you notice? Idaho just put a Democrat in the US House of Representatives. Idaho had the pleasure of electing one of the more distinguished statemen of the 20th century, Senator Frank Church. I don’t know if the Democratic Party of Kootenai County is dead in the water or not; I don’t think it matters. Mike Kennedy doesn’t need the Democratic Party of Kootenai County to get elected in Idaho, because he has widespread, non-partisan support as a result of his scrupulous integrity, thoughtful solution-based pursuits, and collaborative outlook, coupled with his intrinsic sense of fair play and wicked sense of humor. Kennedy plays and I predict a long and successful run in Idaho.

  • Joker on March 15 at 12:19 p.m.

    JBelle,

Let’s see, if the AG releases on the documents, we’ll learn that Mary Souza, Dan Gookin and company were behind this. Shocking.

Then what? Sack up and be counted? What does that mean exactly? I mean really do you think these foks are ever going to admit they’re screwy?

Do you think people in CDA give a rip about LCDC, or Mr. Nipp. Trust me they don’t.

As to Mr. Kennedy, he better win North Idaho if he wants to the win state. Walt Minnich is basicallly a Republican. He defeated a lunatic named Bill Sali. I am not sure that represents a tidal shift in the state. And how many people in Boise know who Mike Kennedy is? He’s a city councilman. From what I can tell a good one. But come on, to make that leap from city councilman to U.S. Senator is a stretch.

He needs to be a mayor, county commissioner, or get elected to the state Legislature next. I think you’re overly optimistic in your assesment of how he will win.

  • JBelle on March 15 at 12:48 p.m.

oh, Joker. You are so schooling me today. And I am grateful because I am poorly at the hand of a casino smoke sinus infection. Far as I can tell, Kennedy hasn’t or isn’t going to announce for the US Senate in the near future—in fact, I believe he’s going back to be a city councilman. So this lesson on how political muscle is built is quite valuable for me and for Mike Kennedy. Heck, Sandi Bloem too! I thank you for laying it out. Lovely, lovey gesture on your part for me, a part of the unwashed, naive masses. God. Who knew? Gain state wide recognition. That is a darn good idea, Joker. I sure hope Kennedy’s reading.

    ;P

  • JBelle on March 15 at 12:54 p.m.

    Joker, gee it’s you AGAIN!

Do I think the people in Coeur d’Alene give a rip about the LCDC? Gosh, I only know what I have read in your previous posts, but did you reverse yourself in this post?

As I mentioned before, as i dont’ live in Coeur d’Alene, so unfortunately the personal matters and the people of the politics involved aren’t of any interest to me. what is of interest, I believe I may have mentioned this, is the question that Charlie Nipp is asking as the moment: if you are volunteer, do you waive your right of due process under the law?

And you know Joker, as fun as it’s been to respond to these little stingy pieces of bait you fling at my feet today, I’m weary. This sinus infection has me down. You know exactly what i mean when I say the people who bent Mike Jorgenson’s ear should sack up. Fact, Jorgenson should sack up, too. If you see him, will you tell him?

  • Joker on March 15 at 2:04 p.m.

    JBelle,

Sorry you don’t feel well. You should rest up. You’re off your game.

I don’t know what “sack up” means as pertains to this situation and I don’t know Mike Jorgenson.

My position about Nipp and LCDC hasn’t changed. Prove that it has.

What I do know is that Mr. Nipp hasn’t been denied his due process under the law. In fact, he’s been treated fairly and justly by the system. They investigated and found no criminal activity.

If you call the police because you suspsect your neighbor is cooking meth. You call because of their strange behavior, lots of cars coming and going at all hours of the day, and shady characters hanging around their house.

The police investigate, determine your neighbors aren’t drug dealers. In fact, all the neighbors are doing is playing video games all night long. The police are under no obligation to tell them where they got the tip about a possible meth den.

Maybe Christie Wood can expand on this, but I am pretty sure accusations are just that.

This is a not a news story that many people really care about. Mr Nipp is making mistake to push this issue. He should while he’s on top. He won. There’s no place to go but down.

  • keithincda on March 15 at 2:41 p.m.

I think you’re wrong Joker. I think it is something a LOT of people are interested in. Maybe not the crowd you run with but I think plenty of people want to see how this will play out. And I think they are on both sides of the fence, pro-LCDC and anti-LCDC.

  • PatrickH on March 15 at 3:09 p.m.

Just a question, and my apologies if it has already been answered. Who is paying Mr. Nipp’s legal fees, is he, LCDC, or is Mr. Reed donating his time?

  • Joker on March 15 at 3:17 p.m.

    keith,

I am curious what percentage of the population in Coeur d’Alene are interested in this issue?

Is it half the town? Or 25 percent. I am thinking 5 percent, maybe less.

  • Aliasjax on March 15 at 3:38 p.m.

I don’t know Joker, but you’ve sure invested a lot of energy into a story you’re not interested in…I guess your interest is in your non-interest, eh?

  • Joker on March 15 at 4:25 p.m.

Great point Jax. Made me laugh…

  • keithincda on March 15 at 5:45 p.m.

    Joker,
right back at ya, 5 % huh? so a super majority is necessary?
Like JBelle, I think this could/may have ripple effect for some folks trying to decide whether to get involved in community service or not.
If you can be accused of something and have that accusation lead to a two year investigation without your knowledge of it, then have it make headlines one day out the blue would you put yourself in the position to have that happen to you? And then not feel as if your rights of due process were stepped on?

  • hmoffsuite on March 15 at 5:57 p.m.

I think the matter should be explored to the fullest extent. As moot as it may seem, it helps define the political landscape in Cda.

  • Joker on March 15 at 6:04 p.m.

    Keith,

No supermajority is needed, but even if we know who went to the AG, who cares?

How did the AG violate Mr. Nipp’s due process?
