Live-Blogging Hart Ethics Hearing

Idaho Reporter is providing live coverage via Twitter of the House Ethics Committee hearing on Rep. Eric Anderson's at 10 o"clock today:

  • 11:44 a.m. Ethics committee votes 6-1 to continue investigation into Hart issues.
  • 11:40 a.m. Loertscher says Hart's consituents had opportunity to act on issue and remove him from office. Hart was re-elected in November.
  • 11:37 a.m. Loertscher plans to vote against motion to continue, says all legislators made mistakes in their past.
  • 11:30 a.m. Brian Kane phones in while traveling, sounds like he is ordering food. Deputy AG Kane says motion on the table to continue seems like a never-ending fishing expedition. Kane says motions must be specific. He also says Hart has the right to challenge payment of taxes.
  • 11:21 a.m. Rep. Wills, now awake, formal opinion from AG's office would be helpful to investigation.
  • 11:20 a.m. Stevenson moves for further investigation into Hart matter. Deputy AG Kane will do investigation. Jaquet seconds.
  • 11:09 a.m. I think Rep. Rich Wills, R-Glenn Ferry, just fell asleep at Hart ethics hearing. Pretty sure that just happened.

  • 11 a.m. Loertscher says committee will act only if Hart used his position as state legislator to avoid tax obligations.
  • 10:53 a.m. Anderson argues that because he complained about violation of oath of office, silver conflict-of-interest issue is relevant.
  • 10:47 a.m. Silver issue is now off-limits because it was not included in original complaint says Loertscher.
  • 10:41 a.m. Brian Kane, deputy AG normally assigned to Hart hearings, is out of state teaching an ethics course.
  • 10:31 a.m. Kelso says Jaquet's questions re: silver are out of line because there is no specific complaint on the issue.
  • 10:28 a.m. Loerscher says he is unsure if anything new has come up that would indicate need for further hearings on Hart.
  • 10:26 a.m. Jaquet and Killen want to force Hart to speak at the hearing. Deputy AG says Loertscher can decide if Hart needs to talk at hearing.
  • 10:22 a.m. Jaquet says Hart should be under scrutiny again because Hart sold liberty dollars for company & then brought legislation supporting dollars. (Hart sold liberty dollars in late 1990's, brought legislation to allow Idahoans to pay taxes in silver in 2010.)
  • 10:12 a.m. Jaquet says because Hart hasn't paid timber fine, the case is relevant and merits further investigationby ethics panel. Actual timber theft by Hart took place in 1996.
  • 10:10 a.m. Killen wants to re-review Hart's failure to pay taxes. Says Hart is in violation of law because Idaho Code requires citizens to pay taxes.
  • 10:06 a.m. Rep. Eric Anderson has included pictures of north Idaho Hart protestors from tour last month. Not sure that is relevant to the case.
  • 10:05 a.m. Today's hearing is only to see if committee wants to proceed forward with charges. No firm decisions will be made today on Hart issue.
  • 10:03 a.m. Starr Kelso, attorney for Hart, has called in to the hearing.
  • 10 a.m. Ethics committee is in session.
  • 9:52 a.m. The maker of the ethics complaint, Rep. Eric Anderson, R-Priest Lake, in the hearing room.
  • 9:51 a.m. Rep. Phil Hart is not in attendance at the ethics hearing, but will call in to the proceeding.
