Can Fillios Serve In Both Positions?

Chris Fillios, a candidate along with Amy Evans for the City Council seat now held by Mike Kennedy, responds to a question during the Kootenai County Democratic Club luncheon earlier this month. Fillios has said at a public forum that he intends to complete his term as an East Side Highway District commissioner, if elected to the Coeur d'Alene council. But that may not be possible. Title 40, Chapter 13, Section 40-1303 of the Idaho code says "County commissioners, city mayors and city council members shall not be eligible to hold office as highway district commissioners." The section involves appointment of Highway Commissioners. But it isn't a stretch to say that it probably prohibits elected highway commissioners from hold county commissioner, mayor, or city council office, too. (Photo: Duane Rasmussen)
