Driver on trial for disabled man’s death

A 37-year-old Spokane man is on trial for vehicular homicide after he ran over a man with Parkinson's disease in 2007.

William L. Hagy struck and killed 51-year-old Robert Kenyon, who was crossing at an unmarked crosswalk on Nov. 20, 2007, at the intersection of 10th Avenue and Rosamond St.

“The state will show you the reason this happened is because the defendant was driving with disregard for the safety of others,” Deputy Prosecutor Mary Ann Brady said in opening statements Tuesday.

But defense attorney Bevan Maxey told the jury that it was foggy that day and suggested Kenyon fell in the roadway.

Hagy “did not see Mr. Kenyon come up on the hood … or anything to indicate he was standing,” Maxey said. “Despite the fact we have had a sad and horrible loss, we will ask you to find him not guilty.”
