Cda Sued Over Lost Concession

A former Hayden city councilman is suing over a lost food concession contract on the shores of Lake Coeur d’Alene.

Gordon Andrea contends the city of Coeur d’Alene cost him his bid to continue a food stand at Independence Point in 1994 by ignoring its own rules. He’s lost more than $10,000 in profits, and suffered violations of civil rights and property rights, he said in a suit filed in Kootenai County District Court.

City specifications required the food vending stand rely on propane for a heat source, Andrea said in a tort claim filed against the city last year. But the city awarded a bid to someone else and allowed the winner to use electricity provided by a generator, the claim said.

The City Council apparently refused the claim, prompting the recent suit. In addition to damages, Andrea is asking for attorney fees.

City Attorney Jeff Jones said he has not yet seen the suit and therefore couldn’t comment.
