Developers Sue Over Restrictions

The developer of a proposed mobile home park is suing the Coeur d’Alene City Council for conditions it placed on approval of the park.

Kenneth and Barbara Clark applied for a special-use permit for a 41-unit manufactured home park on six acres in the Fruitlands addition neighborhood.

The council approved the development on the condition that the Clarks dedicate an 82-foot right-of-way for extension of Neider Avenue. The Clarks appealed the ruling, but lost.

The proposed development was drawn up as having streets only 28 feet wide.

In their lawsuit, the Clarks claim that the requirement amounts to taking their property without just compensation. The property will be made worthless by the right-of-way requirement, they claim, and are asking for damages of more than $10,000.
