Charge Dropped Against Neighbor

(From For the Record, Friday, October 6, 1995:) Shawn McIntyre is banished from coming within two miles of his parents’ house in southern Pend Oreille County, not the opposite as stated in Thursday’s edition.

A reckless endangerment charge was dismissed Wednesday against a man accused of firing a rifle in the direction of a feuding neighbor in southern Pend Oreille County.

Gilbert McIntyre told authorities he fired a shot into the ground on the night of July 19 after someone aimed a spotlight at his house. Neighbor Joe Krawiec denied spotlighting the house, but said he was searching the woods for McIntyre’s son, whom Krawiec suspected of trespassing.

Gilbert and Adelle McIntyre have been in dispute with neighbors Joe and Elizabeth Krawiec and Richard and Diana McSwain for several years. The McSwains and Krawieces are fearful of the McIntyres’ 18-year-old mentally retarded son, Shawn.

Shawn McIntyre admitted raping a 4-year-old neighbor boy in September 1992, but escaped prosecution because he was found mentally incompetent. He continued to live at home after spending about six months in treatment centers.

Since the shooting incident, a judge has banned Shawn McIntyre from going beyond a two-mile radius around his parents’ home. His parents have declined to say where he is living now.

Also since the shooting, the McSwains have filed a $2.5 million claim against Pend Oreille County and Washington state for alleged failure to supervise Shawn McIntyre. If not paid, the claim could pave the way for a lawsuit.
