Apple Growers Push Alar Damage Claim

Rebuffed at every level, Washington state apple growers on Monday will ask the U.S. Supreme Court to hear their claim that a TV broadcast in 1989 disparaged their crop and cost them more than $75 million in losses.

The growers are appealing a U.S. Court of Appeals decision last fall to dismiss the case against CBS Inc., which aired a “60 Minutes” story that alleged apples treated with the pesticide Alar could cause cancer in children.

The growers originally lost their case in U.S. District Court in Spokane.

The Washington Legal Foundation, a public interest law firm, has agreed to represent the growers for free.
