Captured Drugs Will Be Evidence In Irvin’s Trial

Drugs seized from a hotel room occupied by Michael Irvin can be presented to a jury as evidence against the Dallas Cowboys receiver despite being taken in a warrantless search, a judge ruled Monday.

State District Judge Manny Alvarez denied a motion from Irvin’s attorneys to throw out evidence from the March 4 seizure because officers confiscated the drugs without first obtaining a search warrant.

The judge also denied a defense motion to have the indictments thrown out because of alleged flaws in the grand jury that issued them.

Defense attorney Kevin Clancy declined to comment on the judge’s decisions.

“We’ll be ready for trial in the morning,” he said. Jury selection is set to begin this morning.

Clancy and other defense attorneys challenged the indictments in part on grounds that state District Judge Harold Entz used race as a criterion for selecting candidates for grand jury service. Their motion did not challenge the racial makeup of the panel but rather the methods used to select it.
