Senate Votes To Crack Down On Bogus Liens

Legislation cracking down on “vexatious” liens was passed by the Senate in a 28-5 vote Monday and sent to the governor.

The bill, passed by the House earlier, allows county clerks to refuse to record liens that have no legal basis. Tax protesters, constitutionalists and others have taken to filing bogus liens against public officials for huge sums of money in what Idaho Attorney General Al Lance has called “terrorism.”

Though the documents have no legal basis, they can cloud the title to property and require court action to remove.

The bill creates an easier system for removing bogus liens from property and sets civil penalties, including $5,000 fines against those who attempt to file bogus liens.
