Toss Out Evidence, Nichols’ Lawyer Says

Evidence against bombing defendant Terry Nichols should be thrown out because federal agents illegally interviewed him and unlawfully seized bomb-making ingredients and other material from his home, his attorney said in court papers released Tuesday.

Attorney Michael Tigar alleged FBI agents failed to tell Nichols for nine hours that he was in custody and falsely told Nichols he would receive a copy of their interrogation notes and be present during any search of his property.

Besides seeking to exclude the items taken from Nichols’ home and pickup truck, Tigar also said statements should be omitted in which Nichols admitted he and co-defendant Timothy McVeigh were in Oklahoma City three days before the April 19, 1995, bombing of the Alfred P. Murrah Federal Building, which killed 168 people.
