Kaczynski Defense Targets Evidence

Defense lawyers for Theodore Kaczynski asked a judge on Monday to throw out all evidence from the Unabomber suspect’s Montana cabin, claiming the FBI twisted statements from his family to get the search warrant.

Federal defenders cited statements from David Kaczynski, the suspect’s brother, and Wanda Kaczynski, their mother, contending that federal agents distorted their comments in order to justify the search.

Evidence seized from the oneroom wooden cabin - including a bomb, journal and typewriter - is considered crucial to the government’s case against Kaczynski.

It was David Kaczynski who first alerted investigators that his brother could be involved in the case.

But in statements given to defense lawyers, David Kaczynski says federal agents wrongly characterized his suspicions about his brother.

“I told the agents that at that time (December 1994) I had a passing thought that Ted could be involved,” he said. Wanda Kaczynski says the FBI affidavit “is misleading where it states that I noted Ted fit the description of the ‘Unabomber’ and that I believed he must be stopped.”
