City Considers Open-Container Law
Unlike most other Idaho communities, Idaho Falls has no open container law.
The council is trying to come up with a law that will not impact popular downtown events like Oktoberfest and Alive After Five. The draft ordinance limits drinking at festivals and other events to 5,000-square-foot “beer gardens.” The size of the beer gardens is subject to negotiation.
Some advocate elimination of alcohol at events.
“I do not believe we need an open container on a public street in Idaho Falls,” said city Councilman Larry Carlson. He said there is no need to promote public drinking.
