Curfew Violators Could Receive Tickets

Legislation to allow law enforcement to write tickets to curfew violators would mean teenagers face immediate consequences for their actions, said sponsor Rep. Wendy Jaquet.

Local governments would not have to sign on to the idea, the Ketchum Democrat said.

“They don’t have to have a curfew and they don’t have to issue a citation,” Jaquet said. “It gives them another little trick in the bag.”

Currently, police give a report to a prosecutor, who files a petition that is served on the juvenile and parents. A court appearance is later scheduled.

American Civil Liberties Union lobbyist Mike Schwarzkopf said he has no objection to police writing tickets to curfew violators.

An existing daytime curfew in a number of Idaho counties, however, is something the ACLU will consider challenging, he said.
