In brief: Appeal upheld in growth plan claim

The Spokesman-Review

A judge refused Tuesday to dismiss an appeal by a neighborhood group that claims the Kootenai County commission erred when it amended the growth plan to allow for a private golf retreat near Harrison.

First District Judge Charles Hosack ruled that the appeal by Neighbors for Responsible Growth, the Kootenai Environmental Alliance and four families living near Powderhorn Bay could continue.

Heartland LLC of Seattle asked Hosack to dismiss the case. The company wants to develop 1,642 acres with a mixture of luxury second homes and three golf courses.

In October, the commission amended the county’s comprehensive plan to allow for the development.

That’s when the neighbors, who argue the large luxury retreat would change the rural character of the area, appealed.

No court hearing has been set.
