Contractors sue county over track’s unpaid bills
Six local contractors sued Spokane County this week over some $1.1 million in unpaid bills at the West Plains racetrack the county owns.
The contractors claim the county was negligent in allowing the track’s operator, Austin Motorsports Management, to order hundreds of thousands of dollars in repairs without obtaining the required performance bonds that would have guaranteed their payment.
Bucky Austin, the owner of a chain of auto repair shops and a racing enthusiast, won the contract to run the track early this year. But he fell behind on paying bills for the renovations over the summer, and contractors filed liens against the county.
Although Austin vowed in July to make good on all the debts by November, he wasn’t able to obtain financing. He defaulted on his lease agreement and eventually was stripped of the contract by county commissioners.
After taking the racetrack lease from Austin, county officials said they expected the county’s insurance carrier to pay the construction bills after all work and documents were audited.
Patrick Risken, an attorney under contract with the county to handle the contractors’ lawsuit, said Tuesday he was surprised the suit was filed because the audit is still under way and the companies are cooperating with it.
“The audit process is going to continue,” Risken said, adding he didn’t know how long it would take to complete.
Austin was the track’s operator, but the county is its owner, the contractors’ lawsuit says. County officials had a responsibility to make sure Austin was following the terms of the lease and obtaining the necessary bonds, the lawsuit contends.
The lawsuit also notes that Commissioners Todd Mielke and Mark Richard touted the potential benefits of the track when the county bought it for $4.3 million in 2008. “Commissioner Mark Richard is quoted as saying the track would become a positive venture ‘come heck or high water,’ ” the lawsuit says.
County officials have promised to pay the bills but so far have not done so, the suit says. Meanwhile, the county is “unjustly enriched” by having the construction in place at the racetrack, the suit says.

In My opinion,
which of couse with it and 4 bucks might get you a double mocha from your favorite Barista.The initial venture in getting SRP up and running in 2009 was doomed for many reasons right out of the gate,We as Racers and Promotors of the sport did our best to bring you the fans A worthy show.From what I understand the County was in line under the past contract with Austin Motorsports to take such a huge chunk of Gate proceeds that any investor would have been out of his mind to even invest in the venture.Cake and eat it too my friends.
I am not letting Mr. Austin off the hook on everything here,but at least he stepped up and tried to retain a place for our Racers,Fans and Supporters a place to propigate the sport in Spokane County,Which by the way passed this descision.
So many want to sit on the fence and heckle failure for a sport that endorses healthy Family oriented entertainment for both Racer and Fan alike,not to mention a place for an enthusiast of all walks of life to safely and legaly race.Let alone bring much needed revenue to the economy here.
To run this Motorsports park,improvements were an absolute must to bring the degraded conditions of the property up to snuff to and safely and successfully produce a season of racing.”Success” dictated to anyone in the position of producing events at SCR was that the first order of business,spend money to make money.I’m pretty sure thats a rule of thumb in any business venture.Profits do not just happen, it takes sweat equity and cash flow to get it done.It takes a large fanbase to year after year produce a positive profit margin.That being said very few filled the stands at events produced there.Those of you un attended sat and heckled for failure instead of getting behind the intention once the deal was done and voted on.A Flaw that is so prevailent in our own American economy,let alone our current American mindset.Bottom line is you people I mention truly missed out on some premiere events that graced the facility in the maiden venture.
What i would like to let you all know is there are some good people stepping up to get this show re orginized and follow through with plugging the holes in this sinking ship and getting the facility back on track to a profitable port.

Joe Doellefeld, principal partner, of Syringa Management Group announced they have submitted and answered the Request for Qualifications issued by Spokane County for the interim operations of Spokane Motorsports Park, formally known as Spokane Raceway Park.Doellefeld, with over three decades of experience managing and promoting motorsports properties, is currently an owner and promoter of Stateline Stadium Speedway in Post Falls, Idaho.
The submission of the Request for Qualifications detailed a focus on restarting Illegal Street racing mitigation programs, grassroots motorsports events, facility identity, non-traditional uses and outlined a transparent process transitioning into a new operation.

I can see everyone’s point about buying the track because of budget problems. But you must look a little farther down the road. Have any one of you gone out to the track on a Friday night race, or any of the other races that were put on this last year? There were thousands of people and thousands of cars, all the Friday night cars are mostly cars that would be racing on the street instead of at the race track, every one of them paying to get in. This will be a very big PROFIT center for the county; the police have already indicated the advantages to train here instead of having to send all there deputies to other facilities. It is very unfortunate that Austin when too far in the first year, I know for a fact that every one of the changes he made were needed to bring the facility up to a safe and desirable race venue. Please be patient with your harsh words, Spokane has needed a real race track for years, even if your not a “motor-head” it is not any different than providing soccer or baseball parks for people to enjoy there time off with there families.

Few sports can match the exuberance and dedication that racers have I will admit and it will be them, the racers that will have to give something every year to keep this venture open…but there are few if any northern seasonal tracks proximate to B grade cities (Spokane) that turn a profit. I’m not against success I’m just being pragmatic…the only way a track in this area can be successful is to have a crook like Orville running it on a cheap shoestring and bilking it six ways from Sunday to keep it going…and most likely it will go the way of horse racing in this area…

I am not against having a race track for the motor enthusiasts to use. I am against the county owning it. They are not supposed to be taking business away from free enterprise. There is plenty of potential for an independent operator to own and operate the facility. But my tax dollars should not need to be used to do it. Not when my roads are deteriorating faster then they are being fixed, and I am losing more police personnel.
If there are so many that are interested then get a LLC as suggested and buy it from the county, in fact if you wait a year I bet you can get it at rock bottom price.
Also the businesses owed the money are all recognizable reputable businesses in Spokane for as long as I can remember, we cannot afford to hurt these types of businesses that employ many people. The county should pass the hat and get these guys paid pronto.

Let us not forget the contractor who was killed at the track last summer. Undoubtedly his family will be filing a suit for his death, and since Bucky seems to be broke, I’m sure the county will be on the hook for that also.

This is the 2nd lawsuit filed against Spokane County. Per the Spokesman Review (http://www.spokesman.com/stories/2009/jul/21/widow-sues-over-death-at-raceway/), the widow of the contractor killed earlier has filed suit against Spokane County in July. Now, the unpaid contractors are also filing suit against Spokane County.
Richard and Mielke have placed the taxpayers on the hook for what is apparently an unmanageable raceway (the preceding operator failed, the County’s hired manager failed) and the costs of two lawsuits and unpaid construction bills.

FIRST! THE LAWSUITS WILL BE COVERED BY INSURANCE NOT THE TAX PAYERS
if you think about the bucky thing….it actually almost puts the county ahead. They got a lot of upgrades, very quick, and insurance gets to flit the bill.
As for the death of the contractor, that lawsuit has absolutly no basis. There is no such thing as a “safe zone” at a race track. Everyone with half a brain knows that. He was behind a fence, which DID contain the car. However, he was LEANING against the fence which then catapulted him into a tree. That’s like sitting on the other side of a cement barrier on the drag strip, having a car hit it and complaining that the barrier bumped into you. I feel bad for the guy, but it was a fluke and there is no wrongful death there. The widow is just looking for some cash and consolation.
The track is too far along now to close. IT WILL NOT CLOSE and the county will NOT sell it. The sooner you realize this, the better.
How about this. All of you people dissing the track and the county for buying it, I challenge you to go out to ONE racing event next year. I know you’ll enjoy it.

as it’s obvious youve never been to a race.Or you’d know the answer.
Friday Nights Drag Racing,Definately had more participants,
only reason just about anyone can go race their car from your dads borrowed car on up.A run what you brung,keep your kids off the street racing sanctuned event.,
Saturdays and occasionally multiple day events on the Oval track, Punch it and turn left 4 times and do it again with up to 25 oppenents with the same intention.(watch a nascar race) had some great event I think i saw one night where the stands were close to full, everyone there had a ball,
but on average the Oval struggled the most to fill the stands.
I think the Fox hunt Race weekend was stupendous as a fan could get a little taste of every type of race offered as both Oval and The Dragstrip were running,Jet cars and all. a good model for a successful night.

I’ve also been to serveral events. I’ve even hosted an event. There’s nothing that will ever make me support this “seizure” if you will by the county of this 1320 foot strip of bad luck.

First let me say thanks to Kodiakwebracing and a couple other
brave souls for standing up for the sport we love.
I raced at the drag side all year as did my wife and my three sons. Needless to say we supported the track as much as the checkbook would allow.
The statement “you have to spend money to make money” is non-disputable if you’ve ever owned your own business. Very few businesses have thrown the door open in the first year and been imediatley in the black. Especially after the previous owner ran the business into the ground.
If any of you nay sayers were ever out to the track back in the World Finals hay day (late 70’s thru early 80’s) you know what kind of potentential this facility has. If memory serves, 3 day attendence for that race alone was over 20,000.
I was at this years fox hunt race in which the stands closely resembled those times, telling me that with the right kind of management this facility WILL support itself, and bring much needed revenue to the county.
It seems to me that this is more political than anything else. I hate to break this to ya screwball but if the county sold this property for 20 million, you’d still be hitting pothole after pothole. It’s kinda like death and taxes some things are just inevitable.

Watching NASCAR is exciting? Are you kidding me? Not anymore, not for a long time, as any semblance of upset win has gone the way of the Dodo bird. Calling this is a sport is a stretch.

Le Mans style racing is marginally interesting, but going round and round is not.
Sorry, but public interest in motor “sports” is waning and will continue to do so. Why should we tax payers be on the hook for an industry in demise, especially in a severe recession. Idiotic.

Try being in Wenatchee where we have a $55 million arena where the city has to pony up $1 million a year just to pay the interest on the note that is not covered by revenues. That is $1 million per YEAR people. Your $4 million investment will pay off eventually just give it time and quit being so negative. I am sure all of us have made a few financial mistakes along the way. Your commissioners were visionaries and saw potential which I believe is there it just takes time. The best thing to do now is work out of it and not complain. Most of the complainers probably have not been out to the facility on a Friday night which is usually packed with street cars and it’s better to have them there than you know where. There are always going to be complainers and negative people that’s just a fact. Just focus on the positive side, the commitment has been made and it doesn’t do any good to complain now. It will work just give it time.

I grew up in Spokane. Got drunk as a 17yo and visited the race track the night before the inagural drag race. Pee-ed right on the starting line. Used to clean the bleachers for a free ticket. Now I have road and drag raced for 35yrs. You haters don’t have a clue what you have. Moe was a POS but he kept it alive! It was a dump but he kept it alive! He pocketed millions but he kept it alive! He was a POS, but he kept it alive! There is a tremendous pent up demand for a quality track and you can have it. Move on, quit whining, this track will make money. I supported drag racing and road racing there as have thousands. The road course is awesome. Now the drag strip can be too. I’d like to own a piece of the potential. Naysayers go away. I wonder what investment the naysayers have? A few tax dollars? Racers have from several thousand to a million or more. We will support the track.
I don’t know Bucky, I hear he’s an ass and he screwed up, but what he did was made the future possibilities even better.
I guess another option is to expand the Casino. WTH, spend your money there and see nothing for it, cept a fat ass coming out of the buffet! Spokane County has the potential for a premier facility, look around, quit whining, support what you have, others have lost their tracks, don’t lose this one.
