In brief: Police arrest man ‘trapped’ in Arby’s

Some people could only dream about being locked inside their favorite fast-food restaurant. But for one 38-year-old Spokane man, his late-night snack ended in an arrest.

Donald J. Mayberry, who is homeless, told police officers he used the bathroom at the East Sprague Avenue Arby’s on Tuesday night, and when he emerged the business was closed.

So what did he do while “trapped” in Arby’s? He cooked some cheese sandwiches in the microwave, according to a Spokane Police Department news release.

When a janitor came into the store at 2 a.m. Wednesday, he heard the man in the bathroom. The janitor then left and locked the exterior doors, police said.

Mayberry told police that when he realized the janitor found him, he tried to leave through a side door, wearing an Arby’s coat and hat so he wouldn’t look suspicious. Police responding to the burglary report caught him coming out the door. He had a small bag of methamphetamine in his possession, police said.

He was booked into the Spokane County Jail on felony counts of second-degree burglary and possession of a controlled substance.

Pedestrian to be cited after crash

A pedestrian was reported in satisfactory condition Wednesday at Providence Sacred Heart Medical Center after walking onto U.S. Highway 2 and getting hit by a car at Rambo Road on Tuesday evening.

Washington State Patrol troopers said that the pedestrian, Bryan M. Husband, 25, of Spokane, would be cited for being in the roadway.

He was hit about 9 p.m. by a 2007 Toyota Camry driven by Pavel S. Kopets, 67, of Spokane. Kopets was headed east at the time.

Police seek robber of South Hill store

Police are looking for the man who robbed a tobacco accessory store on Spokane’s South Hill on Saturday.

An armed thief took off with money and scales from Piece of Mind at 2824 E. 29th Ave. around 7:30 p.m., a store employee said. The robber went to the store about 30 minutes before the robbery, at first wearing a blue Gonzaga T-shirt, Spokane police said. When he returned, he wore a white T-shirt, a Gonzaga baseball hat and gloves.

The suspect is described as a white male with short, dark hair, less than 6 feet tall with a thin build, 20 to 30 years old, police said. The suspect has tattoos on both forearms, with a banded tattoo on his left wrist.

The U.S. Environmental Protection Agency will extend a public comment period by 90 days for its upper Coeur d’Alene Basin cleanup plan.

Comments on plan will be due Nov. 23.

Idaho Gov. Butch Otter, the state’s congressional delegation and community leaders had asked for an extension of the 45-day comment period, saying the public needs more time to digest the 2,200-page proposal. The plan focuses on improving water quality through the cleanup of mining waste in 300 square miles surrounding the Coeur d’Alene River’s headwaters. The cleanup would cost $1.3 billion, and the work would take place over 50 to 100 years.

Dennis McLerran, the EPA’s regional administrator, announced the extension in a Tuesday letter sent to Idaho officials.

“It is important to EPA that basin residents and other stakeholders understand and have meaningful input into the actions EPA has outlined in the proposed plan,” McLerran wrote.
