Cassidy charged with felony DWI

Entertainer David Cassidy was pulled over in upstate New York for failing to dim his headlights and charged with DWI after tests showed his blood-alcohol content at 0.10, higher than the state’s legal limit of 0.08, authorities said.

Schodack, N.Y., police Lt. Joseph Belardo said Cassidy was stopped Wednesday shortly after midnight about 10 miles south of Albany.

The charge is a felony because Cassidy has a 2011 conviction for driving under the influence in Florida. He lives in Fort Lauderdale but is staying in upstate New York for a racing meet in Saratoga.

The 63-year-old “Partridge Family” star is free on $2,500 bail. He’s due in Schodack Town Court on Sept. 4.

Metallica to headline at the Apollo

There will be a different type of Sandman featured at the Apollo in New York next month.

Metallica is set to rock the legendary Harlem venue on Sept. 21. The band will promote its 3-D concert-action film “Metallica Through the Never,” to be released in IMAX on Sept. 27 and in other theaters a week later. It will also air live on a special temporary Metallica channel on SiriusXM.

The Apollo, revered for its place in black entertainment and historic performances from the likes of James Brown to Michael Jackson, has become a venue for rock legends in recent years, including Bruce Springsteen and Paul McCartney.

And while the Apollo is known for its “Sandman” character who boots weak contestants during its famous amateur show, “Enter Sandman” is one of Metallica’s famous songs.

Photographer sues West over scuffle

A photographer who claims he was attacked by Kanye West at Los Angeles International Airport sued the rapper Wednesday, claiming assault, battery, negligence and violation of his civil rights.

Daniel Ramos claimed his right hip was injured when the rapper punched him in an unprovoked attack and wrestled his camera to the ground. Ramos was a member of the paparazzi who staked out at the airport July 19 to snap celebrity photos.

“I told him twice, ‘I don’t want to fight you,’ ” Ramos said. “However, he attacked me anyway.”

Last week, the Los Angeles County district attorney’s office declined to file felony assault and attempted robbery charges against West, saying Ramos didn’t have a significant injury.

The city attorney’s office was considering whether to file misdemeanor charges.
