Judge Cooney doing his job

It’s obvious that the two letters “Cooney’s Ruling” and “Shame on Cooney” have no legal background. If they did, both would know that it’s the prosecutor who files the charges, not the judge.

If Cooney’s ruling was incorrect, the state can always appeal. That’s why we have the Court of Appeals. Has the state done that? Or was Judge Cooney’s ruling correct?

Get your facts straight before you start blaming Judge Cooney for following the law and doing his job. Perhaps we should be looking at the problems with the prosecutor’s office overcharging cases.

Sgt. John Gately is still being charged with a crime of rending criminal assistance. Let’s keep in mind he never assaulted anyone.
