Kennedy Loses 2 Votes, Brannon 1

  • 4:28 p.m. John A. Cafferty now on the stand.
  • 4:25 p.m. Larry Spencer reports (and Huckleberries has verified) that attorneys stipulated to the accidental illegal votes of three people (Dustin Ainsworth, Nancy White, & 1 other whose name I'll get). 2 (Ainsworth & White) had voted for Kennedy; the other for Brannon. Which means 2 votes were taken away from Kennedy, one from Brannon.
  • 4:10 p.m. From CoeurGenX: "I was released by the circus along with two other 'illegal voters'.. Two were for Kennedy and one was for Brannon.. I was fully prepared to accept that challenge and now I will never get that chance. I am soo disappointed, yet elated to the fact that I can now go on living my life like a normal person and not someone who is associated in any way to the circus which has stopped to visit us here in Mayberry."
  • 2:18 p.m. From CoeurGenX: "This is getting comical. My ex-wife and my former roommate's girlfriend have also been subpoenaed. My former roommate is the person who bought me out of my house in the county, and my ex-wife had been re-fi'd off the same house 10 months prior to that and the city election.. The strange gets stranger minute by minute in our little Mayberry."
  • 1:40 p.m. Deputy Secretary of State Tim Hurst is on the witness stand. Hurst heads up Ben Ysursa's elections department.

  • 11:45 a.m. Dustin Ainsworth posts: "I heard my name was called which I find even stranger considering I was in the court room when the judge called for a break at 10.30 a.m. At that time I asked Kelso's son if I was going to be needed today and he said he didn't know, so I handed him by business card which has my cell phone number and he said he would call me if needed. 30 minutes later my name is brought up and no call …"
  • 11:18 a.m. Kelso gave Carrie Phillips an Excel sheet to review and then called Dustin Ainsworth and Nancy White. Neither were in the court. He then moved on to Barry McHugh. Kelso is asking Barry about John Cafferty (his deputy) and the meeting that was held between city, county, and Mike Kennedy attorneys after Brannon filed suit.
  • 11:03 a.m. Huckleberries hears that ... Dustin Ainsworth and Nancy White have been called as witnesses, but were not in the courtroom. A Berry Picker said Judge Hosack was "perplexed" that the subpoenaed witnesses were not present.
  • 10:43 a.m. Judge Gene Marano has finished testifying. After a break, Team Brannon attorney Starr Kelso called Carrie Phillips to the stand. She replaced Deedie Beard as county elections supervisor. At the 2009 election she was in training to take Deedie's place.
  • 9:49 a.m. Team Brannon legal eagle Starr Kelso is finished questioning county elections worker Susan Smith and now has called witness No. 4 Judge Gene Marano to the stand. Kelso is reviewing the details of Marano's having counted the ballots at the request of McHugh and Kelso.
