One of the more curious legacies of the 2012 legislative session will likely be Senate Bill 1274, the bill to ban texting while driving. The bill passed the Senate 29-6 and the House 53-17. The bill is awaiting Gov. Butch Otter’s signature. Legislators passed this texting ban in an attempt to answer a cry from constituents to “do something” about a perceived problem. But legislators vote on words. Words have meanings and meanings have consequences. In its attempt to stop people from falling victim to distracted texting drivers, the Legislature has created a legal enigma that necessarily will make unsuspecting Idahoans victims of an unforgiving legal system. Question: I can't figure out the hubbub over legislative vote to ban texting while driving. Seems to be common sense to ban such activity. Am I missing something?
