Miami’s Lawyers Cry Foul

Former Miami quarterback Bryan Fortay and his father, Peter, secretly taperecorded 16 conversations with Dennis Erickson and two other coaches, university lawyers alleged.

The conversations are part of Fortay’s $10 million federal lawsuit against the university alleging breach of contract because Erickson started Gino Torretta ahead of Fortay in 1992.

University lawyers say transcripts of the conversations with Erickson, Jimmy Johnson and Gary Stevens shouldn’t be admitted as evidence because they were obtained through wiretapping in violation of Florida law. The Fortays have neither acknowledged nor denied recording the existence of any such tapes.
