Perjury By Witness Prompts Judge To Declare Mistrial

A lying witness prompted a judge to declare a mistrial for one of two men charged with killing a Kirkland man in Pioneer Square last year.

King County Superior Court Judge Larry Jordan granted the mistrial Thursday after the lawyer for Darrell Everybodytalksabout argued that perjured testimony from a prosecution witness would hurt his client’s ability to receive a fair trial.

Prosecutors have charged the witness, Richard A. Prevost, with perjury.

Prevost earlier testified he was with Everybodytalksabout, 40, and co-defendant Philip Lopez, 23, early Feb. 4, 1996, when Rigel Jones was stabbed to death in a parking lot under the Alaskan Way Viaduct in Pioneer Square.

On Monday, Prevost admitted he had been in the Skagit County Jail in Mount Vernon at the time that Jones, 24, was slain, prosecutors say in charging papers.

Meanwhile, the trial against Lopez resumed Thursday when his lawyer, Eric Lindell, opted not to request a mistrial. Lindell said he did not want Lopez to endure several more months in jail waiting for a new trial to begin.
