Man Sues County Over Imprisonment
A man convicted in 1996 of false imprisonment and lewd conduct with a child under 16 has filed a $7.7 million tort claim against Bonner County, alleging false arrest, false imprisonment, battery and other misdeeds.
Patrick R. Clary remains in prison in Orofino, Idaho, but claims he was misled by authorities and denied due process throughout critical stages in his trial.
Although he was originally charged with kidnapping and rape, he was ultimately found guilty of lesser charges and sentenced to three fixed years in prison and an indeterminate number of additional years. Clary claims the charges he was convicted of were never lawfully brought against him.
The injuries that Clary claims to have suffered while incarcerated include two heart attacks, a stroke, brain concussion, a herniated disc, broken vertebrae and emotional distress.
