Moe files lawsuit in effort to stop raceway auction
Two days before a scheduled public auction of the Spokane Raceway Park in Airway Heights, former operator Orville Moe has filed another lawsuit to try to block the sale, Bill Morlin reports.
The public auction of the mile-square racing facility was requested by court receiver Barry Davidson and approved earlier this year by Superior Court Judge Robert Austin to settle ownership claims brought by an estimated 500-600 limited partners.
In response to the new suit, an attorney representing the receiver is asking the court for another “cease and desist order” against Moe.
Attorney John Giesa says Moe filed his new suit “in willful defiance” of the court’s earlier order blocking such filings.
At least two Spokane County commissioners favor buying the track, part of a 580-acre complex that borders Northern Quest Casino, Jonathan Brunt reporter last week.
