Mother of killed 2-year-old released from jail to receive drug treatment

Lovina Rainey was ordered released from jail Friday by a federal judge over the objections of the prosecuting attorney, who said Rainey evaded capture and deleted evidence of drug trafficking from her phone.

Rainey was arrested Wednesday on federal charges of drug possession, intending to sell methamphetamine and possession of a gun to be used in drug trafficking. Detectives found large amounts of heroin and meth in Rainey’s home on 55th Avenue last week while they were investigating the death of her 2-year-old daughter, Adalynn Hoyt, according to court documents.

Her boyfriend, Jason Obermiller, has been charged with second-degree murder in Hoyt’s death. He was arrested Tuesday in Kootenai County and is fighting extradition back to Washington.

Prosecutor Caitlin Baunsgard said in court Friday that Rainey has been evicted from her home and failed to show up to a meeting with Child Protective Services, which has custody of Rainey’s three other children.

Investigators believe after Rainey called 911 to report her daughter’s death and before detectives got a search warrant, Rainey deleted a large number of text messages related to her drug dealing, Baunsgard said.

Investigators also believe drug traffickers are “hunting” both Rainey and Obermiller because they haven’t been paid for 4 pounds of meth, she said.

“(Obermiller) expressed significant concern for his safety from these individuals,” Baunsgard said.

Defense attorney Doug Phelps argued Rainey should be given a chance to be sober when she faces her criminal charges and said she wants to get treatment for her addiction so she can get her children back.

Baunsgard said Rainey could easily leave the treatment facility.

Federal Magistrate Judge John T. Rodgers agreed to release Rainey on electronic monitoring to attend the Good Samaritan Rehabilitation Center in Kootenai County run by the Altar Church. Outreach pastor John Padula was named her third-party custodian. He is responsible for reporting to the court any violation of the release conditions.

Rodgers ordered Rainey to stay away from drugs and alcohol, submit to random urinalysis tests and check in with her lawyer once a week. She also was ordered to surrender her passport.

Rainey’s release from Spokane County Jail is scheduled for Monday.
