9th Circuit wants state response on Monday to emergency motion to dissolve stay

The 9 th Circuit Court of Appeals has just issued an order calling for the state of Idaho to respond by noon on Monday to the same-sex marriage plaintiffs’ emergency motion to dissolve the stay, and clear the way for gay marriage in Idaho. That’s noon Pacific time; then, the plaintiffs, if they choose to, may file a reply by 5 p.m. Pacific. That still could leave time for the court to rule late Monday and allow Idaho counties to issue marriage licenses to same-sex couples when they open on Tuesday morning after the three-day Columbus Day holiday weekend, or perhaps to rule on Tuesday morning.
