In the arguments, Craig attorney Billy Martin told the court, “There’s no evidence in the record to support that appellant was there for any reason other than a legitimate reason, to use the facilities.” Also, Minnesota prosecutor Christopher Renz told the court that friend-of-the-court arguments from the American Civil Liberties Union that Craig’s actions were protected free speech don’t apply, because Craig’s actions in the stall weren’t “expressive conduct.” “He did not intend to express, according to him, anything by his conduct,” Renz told the court. The justices have 90 days to issue their ruling.
