Truth about Schiavo case

Regarding the Nov. 11 letter by Mr. Jeffrey Bourget, the Terri Schiavo case involves the Fifth and Eighth amendments, not the 10th, as is demonstrated every time a state death sentence case goes into federal court to ensure the “rights” of the individual. There was no violation of federalism in the attempt to prevent the state-ordered starvation of an innocent and helpless Ms. Schiavo at the behest of her well-compensated husband. Ms. Schiavo’s fate is, however, indicative of what can be expected under rationed national health care, by our president’s own words.

The Harvard study claiming the deaths of 44,000 people annually because of no health insurance is a biased statistical extrapolation. Humans die of injury or disease, not “no insurance syndrome.” No one is turned away from an emergency room. We have Medicaid.

Article 4, Section 3 of the Constitution forbade the formation of “The Confederated States of America” without the consent of the Congress and is therefore not “reserved to the State” under the 10th Amendment.

Finally the “clear intent” of the framers as to how “living” the Constitution shall be is specified in Article 5, the amendment process, which is laborious and time-consuming by design.
