Phil Hart’s appeal: “Hart should know that to argue the contrary is to attempt to deceive this Court. For Hart to take the extra step and claim the Commission has committed an offense which warrants sanctions (for Hart’s claimed incorrect interpretation of Smith by the Commission) against the Commission’s attorney under I.R.C.P. 11, is unthinkable.”
