Push For Higher Seatbelt Fines Ahead?
There is a chance that the 2012 Idaho Legislature may consider legislation altering the fine amount for seat
belt violations, basically changing the law so anyone cited would pay a fine of $61.50. Currently, adults cited pay a $10 fine, while children under the age of 17 without a belt are subject to the $61.50 fine. Under consideration is designating seat belt violations as a primary offense in all cases, rather than a secondary violation. Seat belt laws are divided into two categories:
primary
and
secondary
. Primary seat belt laws allow law enforcement officers to ticket a driver for not wearing a seat belt, without any other traffic offense taking place. Secondary seat belt laws state that law enforcement officers may issue a ticket for not wearing a seat belt only when there is another citable traffic infraction
