Court acting unconstitutionally
A book I am writing, “The Tyrannical Rule of the United States Supreme Court,” could easily be retitled “The Tyrannical Rule of the Supreme Court of Washington.” The court has unconstitutionally inserted itself into the education fracas, and now will punish the state with a daily fine until it adheres to the court’s ruling concerning providing “ample funding” for schoolchildren.
The court is a co-equal branch of government, not the only branch, and must remain within the boundaries set for it by the state constitution. It has no authority to demand that law be written or that provisions be carried out; that is the business of the legislative branch.
Why is the Legislature not doing something about this unconstitutional action? Who will enforce the fines? The court has no police or other agency to collect the money. Its demand that a fund be set up for the deposit of the money to be spent for education is unenforceable.
The question is where will the court stop if it gets away with this grab for power? What next sentence or phrase in the constitution will the court decide it can enforce? Hold your breath; there is more intrigue to come.
