UI students’ legislation on alcohol, medical emergencies passes House

The House has voted 65-5 in favor of HB 521 , legislation proposed by the Associated Students of the University of Idaho to grant “medical amnesty” from charges of underage drinking or minor-in-possession when the offense comes to light because the minor involved needs emergency medical help. “These are young people whose judgment has been clouded by the use of alcohol,” Rep. Carolyn Nilsson Troy, R-Genesee, told the House. “When something is going wrong, let’s make sure our kids aren’t afraid to make the right choice.”

She said the bill would encourage young people to seek emergency help when it’s needed – not refrain out of fear of charges. UI student lobbyist Nate Fisher Jr. told an earlier House committee hearing that 31 states already have passed similar legislation, including most of the states surrounding Idaho.

The five “no” votes came from Reps. Anderst, Clow, Dixon, Harris and Pence. The bill has three legislative co-sponsors, Troy; Rep. Kelley Packer R-McCammon; and Senate Judiciary Chair Patti Anne Lodge, R-Huston. It now moves to the Senate side.
