Clarifying the case

In Sue Lani Madsen’s recent column on campaign finance enforcement, she criticizes the penalty I am seeking in a recent lawsuit against two Grant County individuals, whom she defends as “two amateurs.”

Ms. Madsen neglects to inform Spokesman-Review readers that Jerry Moberg, one of the defendants in the case, is an experienced attorney and former Superior Court judge. He is hardly an “amateur.”

Our lawsuit also alleges that Mr. Moberg and his associate purposefully shrouded their actions and misled investigators — under oath. Ms. Madsen neglects this important allegation, too.

These are serious charges warranting a significant penalty. Anyone considering intentionally violating our campaign finance laws and misleading investigators under oath should know they will be held accountable.

Their penalty will not, and should not, be a slap on the wrist.
