Deputies find shivering 2YO in pajamas, no shoes, along Government Way/Hayden

Kootenai County Sheriff’s Office news release:

At approximately 7:30 AM Saturday, deputies were called to the 8600 block of Government Way/Hayden for a report of a small child without socks or shoes, dressed only in pajamas, walking along the roadway.

Upon their arrival in the area, Deputies found a 2 year old male with a dirty face who was shivering, cold to the touch, and not wearing socks or shoes in the 47 degree temperatures. The child had attempted to cross Government Way to see the “Tonka Trucks”, which were large pieces of construction equipment across the street.

Deputies were able to locate the child’s father, Castulo P. Costilla (pictured), in a nearby apartment with the front door open with him passed out on couch. Once they were able to wake Costilla, he told deputies that he’d been using methamphetamine, had been awake for two days, consumed heavy amounts of alcohol the night before, and then smoked marijuana earlier in the morning before falling asleep. Deputies did locate methamphetamine in the apartment within the reach of a small child next to several toys. Later on in the investigation, it was also discovered that Costilla had previously been in possession of a handgun which he had stored loaded under a bed without the consent of the person who owned the apartment. Deputies took possession of the firearm at the request of the person renting the apartment.

Based on the investigation, Costilla was arrested and charged with Felony Injury to Child, Possession of Methamphetamine, Possession of Marijuana, Illegal Possession of Prescription Medication, and possession of paraphernalia.

Costilla has a very lengthy criminal history to include two previous Injury to Child charges in 2011 and 2012. He also has numerous probation violation convictions, felony drug charges and an arrest in 2014 for Domestic Battery. Costilla has also had previous felony charges out of California and Arizona.
