Just four justices to be present in court today, Eismann out sick

Justice Daniel Eismann won’t be participating in today’s arguments in the grocery tax case, as he’s out sick. Eismann will watch the arguments via livestream and still will take part in the decision, but he won’t be asking questions today. That promises to change the dynamic today, especially since Eismann engaged in extended, angry exchanges with Deputy Attorney General Brian Kane, who is representing Idaho Secretary of State Lawerence Denney in court today, the last time Kane argued a case at the Idaho Supreme Court.
