A judge on the Idaho Court of Appeals since 2002, Gutierrez first became an Idaho district court judge in 1993. He previously practiced law in Caldwell and worked for Idaho Legal Aid Services and the Idaho Migrant Council. He holds a bachelor's degree, cum laude, in elementary education from Boise State University and a law degree from the University of California Hastings Law School. Gutierrez is Idaho's first - and still only - Latino judge. He was the recipient of the Idaho Supreme Court’s Kramer Award for Excellence in Judicial Administration Kramer Award in 2013.

When newly appointed Idaho Judge Sergio Gutierrez traveled from Canyon County to Weiser for his first first-degree murder trial in 1993, he was surprised by what he found there.
