Man who raped 3-year-old gets 13-year sentence

A man who raped a 3-year-old boy twice and nearly killed the child was spared an above-standard sentence Thursday as a U.S. Supreme Court decision continued to play havoc in Washington courts. Superior Court Judge Jerome Leveque emphasized that the standard maximum 131/3-year prison term he imposed on 26-year-old Cory G. Preston was the most he felt he was allowed to hand down.

A 25-year-old Spokane woman was sentenced Wednesday to six months in jail for a sexual relationship with a 14-year-old boy – who didn't complain until he also was jailed. Georgia Betty Jean Cooper's husband, Cody Cooper, stood up for her in court Wednesday along with her pastor.

A 20-year-old Spokane man is to be sentenced Dec. 16 for murdering his infant daughter before she was a month old. Casey Allen Biotti pleaded guilty last week to second-degree murder in a plea bargain in which a charge of homicide by abuse was reduced and a second-degree child-rape charge was dismissed.

A 21-year-old Spokane man pleaded guilty Friday to first-degree murder for stabbing his ex-girl-friend's stepmother to death last December. Nathan W.L. Giorgianni told police he killed Yukiko Evans in her home in the 200 block of West Montgomery "as a gift" to her stepdaughter, Jennifer Evans.

Appeals court upholds man’s prison term

Morris "Mel" Goldberg can't blame his attorney for the 262/3-year prison term he got for helping murder his son-in-law, the Washington Court of Appeals said this week. In a ruling released Thursday, the Spokane branch of the appellate court dismissed Goldberg's appeal, which had been based on the grounds that Public Defender John Rogers didn't seek a below-standard prison term when Goldberg was resentenced last October.

Woman convicted in stabbing death

A Spokane woman has been convicted of first-degree murder for jumping on another woman's back and stabbing her in the head to steal crack cocaine. A Superior Court jury convicted Sabrina Marie Kendall, 29, Monday in a trial that began the previous Monday. She faces a standard sentence of at least 25 years.

Candidates, tax increase on rural ballots

Stevens County residents will get another chance Nov. 2 to approve a 0.3 percent sales tax increase to ensure that sheriff's deputies have reliable cars and to cover other criminal justice costs. In Stevens and other rural northeastern counties, residents also will vote on a number of school, fire and cemetery operating levies. Lincoln County commissioner races were decided in the Sept. 14 primary election, but Stevens, Pend Oreille and Ferry counties still have contested commissioner races.

A Spokane County jury was declared hopelessly deadlocked Tuesday on the question of whether Charles Sean Tillman should be locked up for sex crimes he might commit in the future. The jury of six men and six women deliberated for 17 hours over four days in an unusual trial that resembled a sanity hearing.

A Springdale, Wash., man was convicted Friday of assaulting his premature infant while the baby was less than 3 months old. A Stevens County jury found Mark Anthony Conner Jr. guilty of one count of second-degree child assault, but it was unable to reach a verdict on two other counts of second-degree child assault.

Trooper not to blame for death

A state trooper trying to stop a speeding motorist was not responsible for a fatal crash two years ago at Francis and Monroe even though he was negligent, a Spokane County jury ruled Friday. Jurors deliberated nearly two days before concluding that Washington State Patrol Trooper Robert Fiorentino's negligence didn't cause the July 2, 2002, death of 15-year-old Tesia Parris.

Nurse pleads guilty to rape

A 35-year-old nurse pleaded guilty Thursday to two counts of raping a completely helpless 12-year-old girl in April while she was in his care. Raymond Carl Hughes was supposed to be watching over the quadriplegic girl at her north Spokane home when he raped her.

Dog breeder apologizes for whacking TV camera

A Pend Oreille County dog breeder who drew nationwide attention in a 1997 animal-cruelty trial apologized Friday for whacking a television cameraman after losing a lawsuit accusing her of selling inbred bulldogs. Jeanette Bergman, 53, said she was upset about the small-claims verdict in Pend Oreille County District Court and had just told a KREM television news crew she didn't want to speak on camera.

State wants to lock up man as sexual predator

A Spokane County jury began hearing testimony Thursday to decide whether a 35-year-old sex offender should be locked up for crimes he might commit in the future. The state Attorney General's Office says Charles Sean Tillman needs to be in custody or under supervision for the rest of his life because he is a sexually violent predator.

Man allegedly kidnapped ex-girlfriend

A Medical Lake-area man has been charged with kidnapping his estranged girlfriend and attempting to rape her in an Aug. 9 incident in which he shot himself. Tony W. Desautel, 34, faces trial next month in Spokane County Superior Court on one count of first-degree kidnapping and one count of attempted second-degree rape.

The U.S. Supreme Court is being asked to decide whether sauce for the goose is sauce for the gander. The court ruled in June that criminal defendants have a right to have juries, not judges, decide facts used to determine above-standard sentences in state courts. Colfax sailor admits killing infant son

A 21-year-old Navy seaman from Colfax has pleaded guilty in a court-martial to murdering his 28-day-old son in Japan to keep the baby from interrupting a video game. "He was making some noise. He was a little fussy," Robert Howard told a military judge this week, according to the Stars and Stripes newspaper for military personnel. "I wanted complete concentration for the game."

Court can’t fix sentencing law

Two Spokane County Superior Court judges ruled in high-profile criminal cases Friday that they can't fix an unconstitutional law that used to allow above-standard sentences. As a result, the man who fractured 89-year-old Belle Ensminger's skull while snatching her purse in February will get less than half the prison term of his accomplice, who didn't touch Ensminger.
