Little League Suit Dismissed

With the defendant in class in the fourth grade, a judge dismissed a lawsuit over a wild throw made by a 9-year-old boy before a Little League game.

The decision ended a 2-1/2-month ordeal for Johnny Lupoli. He was sued in December by a woman who was injured when struck in the face by a baseball tossed by the Wallingford boy.

The suit was dismissed on a technicality, with the judge ruling a child cannot be sued as a sole defendant.
