Arrasmith Doesn’t Want Trial In Cda

Convicted double-murderer Kenneth Arrasmith doesn’t want the civil trial against him to be held in Kootenai County.

His attorney, Craig Mosman, on Thursday asked a North Idaho judge to move the case two hours south from Coeur d’Alene to Nez Perce County where the murder happened.

Arrasmith was convicted of gunning down Ronald and Luella Bingham at a Lewiston auto repair shop. He claims they had sexually abused his teenage daughter.

The orphaned son of the two victims filed a wrongful death suit against Arrasmith in Kootenai County, where the boy’s attorney lives. Joshua Bingham, 17, is asking for more than $10,000 for the loss of his parents.

On Thursday, Mosman asked 1st District Judge Gary Haman for a change of venue in the case. Having the trial in Coeur d’Alene, 120 miles away from where most of the witnesses live, would be difficult, he said.

But the boy’s attorney, Harvey Richman, argued that it would be hard to find an unbiased jury in Lewiston because the case has been so prominent.

Richman also said that since Arrasmith was a Washington resident, he has no legal right to say where he wants the trial to be.

Mosman argued that his client is now an Idaho resident because he’s in the Idaho State Prison system - giving him the right to choose the trial location.

Judge Gary Haman denied Arrasmith’s request although he left it open for Mosman to file another request for a change of location.
