Prosecutor intends to try man again on murder charge

A man who had his first-degree murder conviction erased earlier this summer will remain in jail unless he can come up with a portion of his $500,000 bond that a judge handed down Wednesday. Superior Court Judge Greg Sypolt in July ordered a new trial for Jeramie R. Davis, who had been sentenced in 2008 to 40 years in prison for the bludgeoning death of a 74-year-old adult-bookstore owner. Davis admitted to stealing pornography and sex toys from the store but denies killing John G. “Jack” Allen, saying the owner was dead when he got there.

New trial begins in fatal 2007 shooting

Former online prostitute Shellye L. Stark arrived Tuesday at the Spokane County Courthouse for a rare second chance to convince a jury that she was simply defending herself in 2007 when she shot her estranged husband to death at their South Hill home. One jury already has convicted Stark, 50, of murder and conspiracy to commit first-degree murder in the death of Dale R. Stark, rejecting her self-defense claims during a 2009 trial.

Man killed by deputies did not have weapon

A man killed Wednesday by two Spokane Valley sheriff’s deputies was unarmed, but Sheriff Ozzie Knezovich said Friday that deputies fired only after the man said he had a knife and charged the officers. Deputies responded to a home at 1309 N. Skipworth Court on Wednesday after the woman who lived there called to report that Edward S. Gover, 47, had held her hostage overnight and had cut her on the arm with a knife when she tried to escape.

Police won’t say if suspect was armed

Law enforcement officials are refusing to say whether a man killed by deputies Wednesday was armed when he was gunned down in his girlfriend’s backyard in Spokane Valley, though the man’s best friend claims that he was not. Spokane County Sheriff Ozzie Knezovich also would not identify the deputies until they give full interviews today to Spokane Police Department detectives. He said the two-day delay has nothing to do with his elimination in 2010 of a policy that called for a 72-hour wait before deputies were questioned.

Woman accused of arson released

Because investigators failed to turn over required paperwork, a judge on Tuesday ordered the release of a 33-year-old woman suspected of trying to torch a taxi and a building on the Riverpoint campus. Spokane County Superior Court Judge Annette Plese told Daniele L. Williamson that she would be freed following an afternoon court appearance where prosecutors had intended to seek her detention on two counts of arson, attempted first-degree robbery, armed first-degree burglary and third-degree theft. She was arrested Sunday night just after the fires were discovered, shortly after 10 p.m., according to the Spokane Fire Department.

Zehm defense presents case for retrial

Carl Oreskovich argued Friday that former Spokane police Officer Karl F. Thompson Jr. should receive a new trial because federal prosecutors hid information from the defense that could have won his acquittal. However, several assistant U.S. attorneys disputed the assertions, countering that they had done everything required, and instead called into question the credibility of a forensic video expert who alleged prosecutorial impropriety.
