IDynaTECH founders sued by former employer
Three Spokane software developers have been sued by their former employer, a San Francisco company that says the three launched a competing technology firm in violation of a contract it had with them.
Citing non-compete and non-disclosure clauses in their contracts, San Francisco-based Data Mosaics, Inc., filed the suit in Spokane County Superior Court recently.
The suit names Daniel K. Ferguson, Gregory Patnude and Jeffrey R. Leitner, as well as the Spokane company they formed last December, IDynaTECH Inc.
The three men had worked for a Spokane Valley office operated by Data Mosaics. They left last year after the company downsized the Spokane office.
They created IDynaTECH Inc. to develop business applications that can move data faster and more efficiently than traditional Web data tools. IDynaTECH leases space in the Sirti building on the Riverpoint Higher Education Campus.
Data Mosaics was launched in 2000 by Mark Graybosch. Graybosch contends in the lawsuit that the alleged contract violations will harm his business. The amount of damages will be determined at trial, the suit said.
Ferguson, the CEO and president at IDynaTECH, said he had not yet been served with the suit. “We don’t have any revenue yet, so I can’t see how we can be competing with Data Mosaics,” he said.
He said IDynaTECH has avoided contacts with past Data Mosaic customers, adding he believes the California company does not sell its products to businesses in Washington state.
