Canfield Mountain plan moves forward

The Spokesman-Review

Marvin Erickson’s plans to put 44 homes on the face of Canfield Mountain have been revived after a mediation agreement with the Idaho Supreme Court.

In the agreement reached Oct. 27, Kootenai County will allow Erickson to move ahead with his 2003 proposal to put 44 upscale houses near his own home on the landmark Coeur d’Alene hillside.

“We are very happy to be once again working with Kootenai County in the spirit of cooperation,” said Scott Poorman, Erickson’s attorney.

Erickson sued the county, arguing that the planning director illegally threw out his application for the Erickson Estates. In March 2005, Erickson scaled back the home sites to nine and created lots in areas not included in the original proposal. It was these changes that prompted the planning director to yank the application, which had been dormant for 19 months.

In June, a 1st District Court judge ruled that the county did have the authority to throw out the application. Erickson appealed to the state Supreme Court, which resulted in last month’s mediation.

Deputy County Attorney John Cafferty said the county will move forward and review the original plan for 44 homes. If Erickson opts to drastically scale back the number of home sites, Cafferty said the county might reject the plan again.
