Court: Tranfer Fee Unconstitutional Tax

In a sharply divided 3-2 decision, the Idaho Supreme Court has agreed that the state’s “transfer fee” to finance liability insurance for underground fuel storage tanks is an unconstitutional tax.

It wasn’t immediately clear whether the state faces the prospect of making millions of dollars in refunds for revenue generated by the program since 1990.
