Jurors Unable To Reach Verdict Dibartolo Jury Will Resume Deliberations Today

Jurors in the Tom DiBartolo murder trial deliberated for eight hours Thursday without reaching a verdict.

They’ll resume today around 8:30 a.m. in the courtroom of Superior Court Judge Neal Q. Rielly.

Deliberations Thursday were described as “normal” by a court spokesman. Jurors did not send requests to Rielly asking for clarification of issues.

Defense attorney Maryann Moreno unsuccessfully sought a mistrial Wednesday after two jurors reported a security guard had told them he would convict DiBartolo if he were a juror. The comment reportedly was made as the jurors left the courthouse Wednesday night after spending four hours reviewing evidence.

Rielly ruled the incident was not serious enough to declare a mistrial.

The eight-man, four-woman jury heard testimony from more than 115 witnesses during the five-week trial.

Prosecutors allege DiBartolo murdered his wife of 19 years while walking in Lincoln Park on Nov. 2, 1996. He is accused of wounding himself to support his story of being attacked and robbed by two strangers who demanded money.

During two days of testimony, the 43-year-old DiBartolo testified he did not kill Patty DiBartolo.
