Eye On Boise: The Legal Arguments

The legal arguments in Sen. Larry Craig’s filing in Minnesota this morning go on for 16 pages, followed by attachments including an affidavit from the senator and copies of the police report, transcript of the interview of Craig by the arresting officer, charging document and plea agreement. The introduction in the motion sets the stage about the “fear” and “panic” Craig felt regarding the Idaho Statesman investigation. The arguments go on to suggest that Craig interpreted the officer’s comments as a promise that if he pleaded guilty, the incident wouldn’t come to public light. “I don’t call media, I don’t do any of that type of crap,” the arguments quoted the officer saying in his interview with Craig. When Craig signed the plea agreement, “in his mind, the terms of the plea included the promise made by Officer Karsnia that the alleged incident would not be released to the media,” the motion states. Later, it notes, “Senator Craig is not a lawyer, and like any other non-lawyer, should not be expected to understand the intricacies of constitutional law"/Betsy Russell, Eye On Boise.
