Riverside Harbor Feud Delayed In Court

An attempted takeover of their homeowner’s association by Riverside Harbor residents is tied up in court.

More than 30 residents of the Post Falls subdivision packed a 1st District Court room Tuesday. They were hoping Judge Gary Haman would rule that a special meeting they called in November was a valid meeting of the Riverside Harbor Homeowners Association.

At the meeting, the residents voted to oust the association’s board of directors, which has been controlled by Riverside developer Dennis Swartout for years.

The developer’s attorney accused the residents of election irregularities bordering on voter fraud.

Haman called the case unusual.

“I can’t recall ever having to rule on an election procedure,” he said. “You might be better served to petition the United Nations. Perhaps they could station pollwatchers.”

Haman postponed his decision to give Swartout’s attorney time to respond to affidavits submitted by the homeowners.
